Over 30 years passed before another patent application was filed with the Patent Office for a device similar to a modern electronic cigarette. The inventor was the American Herbert A. Gilbert. He named his device "a smokeless cigarette without tobacco." The device was much smaller than its predecessor dated 1927. It was already treated like a cigarette, although Gilbert did not deny the possibility of using it as a medical inhaler.

In 1963, Herbert Gilbert applied for the registration of his patent. Two years later, the patent for the first electronic cigarette was finally granted to the inventor. Herbert Gilbert's invention was then mentioned in the 1965 December edition of “Popular Mechanics” as a “new smokeless cigarette without tobacco”. Gilbert succeeded in constructing a working prototype of his invention, however, as it often happens, Gilbert's invention was a head of its time, and alas, did not find a wide practical application.

He had been failed for a long time but constantly tried to improve his project. In 2003, at the age of 52, Hon Lik patented the blueprints for a "flameless atomized e-cigarette". The patent application contained only drawings, schemes, and the theoretical principle of operation since at that time there was no finished product, and there was no slightest idea what it could be made from and how. His application argued that no smoking substitute could saturate the blood with nicotine soquickly. This interested the company "Golden Dragon Holding" Hon worked for, which was the impetus for the production of the first electronic cigarette. In October 2004, under Hon's patent, the company produced and launched the first batch of "e-pipe" products in the market. The first series looked like apipe for smoking, was uncomfortable, large, and not practical, but received positive feedback. The Golden Dragon Group sold Hon Lik's invention for $75 million to the tobacco giant Imperial Tobacco. Hong said the money had nothing to do with him asit was a deal between the companies. However, Hon was pleased to see that the price of the deal reflected the value of his invention.
